Section 10.25.110 Nonconsensual towing storage lots.

No towing company shall transport a vehicle from a nonconsensual tow to a storage lot which is outside the limits of the City of Sioux City unless the location of the lot has been specifically approved by the city council. All towing companies, immediately upon hooking up to a vehicle for a nonconsensual tow, shall tow the vehicle directly to a twenty-four hour storage lot. Such towed vehicle shall not be temporarily dropped, placed or left at any other lot or on any other property. A twenty-four hour storage lot shall provide vehicle return services twenty-four hours a day seven days a week. Storage lots do not have to be staffed twenty-four (24) hours a day but instead may use a telephone service. Calls to the telephone service must be answered twenty-four (24) hours a day seven (7) days a week and a person with authority and ability to release the vehicle must respond to the location of the vehicle within one hundred and twenty (120) minutes of completion of a telephone call to the posted telephone number. The requirement to return vehicles on a twenty-four (24) basis shall apply only to cars towed in the last twenty-four (24) hours. Vehicles that have been at the storage lot more than twenty-four (24) hours may be held until regular business hours. If the release of a vehicle is delayed at the request of the storage lot no additional storage fees maybe charged for that time. The fees for storage shall not exceed a before sales tax rate of $17.50 per day. The allowed charge will cover a twenty-four hour period, not a calendar day.  (Ord. 2008-0169; 2005-0084; 2004-0232)
