Chapter 10.30 MISCELLANEOUS CITY RULES OF THE ROAD
Section 10.30.110 Handicapped parking restrictions.
1. No person shall stop, stand or park a vehicle in any space designated as
a handicapped parking zone on
public or private property unless said vehicle is to accommodate a handicapped person while in that
parking
space, and there is displayed on or within said vehicle so as to be clearly legible from outside said
vehicle, a
handicapped person's special identification device issued by the state of Iowa or a similar identification
device validly issued by another state, county, city, or federal government.
2. Handicapped parking spaces located on privately-owned property shall be designated
by appropriate
signs as prescribed by the Iowa Manual on Official Traffic Control Devices for Streets and Highways.
Signs
shall be installed in accordance with specifications prescribed by the city of Sioux City. Such
handicapped
signs shall be erected and maintained by the owner, lessee, or person in charge of said private property.
3. Nothing in this chapter shall relieve a person using a special handicapped
parking space from paying
the usual parking fee for such space.
4. The penalty for unauthorized use of decals shall be a fine of not more than
one hundred dollars or
imprisonment not to exceed thirty days. Parking violations shall be charged and prosecuted in
accordance
with the provisions of Chapter 10.24.
5. Violations of subsection 1. which are admitted may be charged and collected
upon a simple notice of
fine and no costs or surcharge shall be assessed. Violations which are contested shall be handled
through
the appeal process. Parties wishing to appeal a notice of fine shall present the notice within twenty-four
(24)
hours of issue to the Sioux City police department. A peace officer will issue them a uniform citation
assigning a court date and adding court costs to the fine.
6. In the event of a violation of the provisions of Section 10.30.110 regulating
handicapped parking, it
shall be the duty of police officers, parking meter attendants, code enforcement officers, and other
individuals authorized by the chief of police, to issue a notice of a fine and attach it to the vehicle. The
notice shall state the violation involved, the state and license number of the vehicle, location and
the time
the ticket was issued. The police chief may authorize owners of real property to issue notices
of fine for
parking violation under this section on their parking facilities. The police chief may further authorize
civilian volunteers who have been screened through the police department to issue a notice of fine for
violations of this section.
