Section 10.30.360 Equipment for moped operators and riders.

    1. The term "moped" includes any motor vehicle designed to travel on not more than three wheels in contact with the ground, with an engine having a displacement no greater than fifty cubic centimeters, or not capable of operation at a speed in excess of twenty-five miles per hour on level ground, unassisted by human power.
    2. No person under the age of eighteen shall operate or ride a moped upon any street within the city of Sioux City, Iowa, unless the person is properly wearing a safety helmet and eye protective equipment which comply with the standards set out in subsection-3. of this section.
    3. The Federal Motor Vehicle Safety Standard 218 "Motorcycle Helmets" (49 CFR 571.218) and the American National Standards Institute Standard Z90.1 are established as the minimum performance requirements for safety helmets, and Vehicle Equipment Safety Commission Regulation VESC-8 is established as the minimum performance requirement for eye protective equipment for moped operators and riders.  The above standards shall be available for public inspection and copying at the office of the city clerk.
    4. When operated on a street or highway, a moped shall have a bicycle safety flag which extends not less than five (5) feet above the ground attached to the rear of the moped.  The bicycle safety flag shall be triangular in shape with an area of not less than thirty (30) square inches, and be day-glow in color.  For failure of having a bicycle safety flag on a moped in violation of this subsection, the scheduled fine is five (5) dollars.  (Ord. 91/T-10306)
