Any person who is the owner/operator of a PTV, or their lawful guardian in the case of a minor, who violates the provisions of this chapter may, in lieu of a citation, allow the present PTV to be impounded by the City for not less than five days for the first offense.  Upon the second or any subsequent violation within a twelve month period the police department may seize the person’ s PTV and hold the vehicle for ten days for the second offense and thirty days for the third and any other subsequent offense.  With a second violation and any subsequent violations the PTV may be seized and a citation may be issued pursuant to section 1.04.100.

    The owner/operator may request an administrative hearing within 24 hours of impoundment. If a hearing is requested, the hearing will be conducted in the manner set forth in Section 10.82.110. (Ord. 2005-0193)
