Section 10.82.090 Owner to present evidence of identity and pay costs prior to return of vehicle.

    Before the owner or other person lawfully entitled to possession of any vehicle which has been impounded under the provisions of this chapter or any other provisions of law may recover such vehicle, such person shall present to the department evidence of such person's identity and right to possession of the vehicle, shall sign a receipt for its return, and shall pay the costs of removal, preservation, storage, notification and preliminary costs of sale except when, and to the extent, said costs have been waived after hearing under Section 10.82.110.
    For all abandoned motor vehicles towed under the provisions of Section 321.89(1)(b)(1), (2), (3), (4) and (5), the Code of Iowa, the owner shall be assessed a fee of $35.00 to be paid to the city before the motor vehicle is released.  This paragraph shall not apply to a motor vehicle which has immediately preceding its towing been made inoperable as the result of a motor vehicle accident or to a motor vehicle which is abandoned under subsection 321.89(1)(b)(5) if the owner is actively attempting to remove the vehicle.  (Ord. 95/U-3058, 84/T-2722).
