Chapter 12.03 ELECTRICITY FRANCHISE TO RURAL ELECTRIC COOPERATIVE
Section 12.03.020 Franchise to Woodbury County Rural Electric Cooperative.
A non-exclusive franchise is hereby granted unto Woodbury County Rural Electric Cooperative, a
corporation, its successors and assigns, (herein "Grantee"), for a term of twenty-five (25)
years,
commencing with the date this ordinance becomes effective, and Grantee is granted the right to acquire,
construct, install, maintain and operate electric generating plants, electric transmission systems and
electric
distribution systems (herein "Electric Utilities") over, across and under the streets, alleys
and public
grounds in that part of the existing Woodbury County Rural Electric territory as established by the
Utilities
Commission of the State of Iowa within the City of Sioux City, Iowa (herein "City"). Grantee
is granted the
right to generate, supply, transmit and distribute electrical energy to all consumers within the present
and
future corporate limits of the City that fall within the Woodbury County Rural Electric Cooperative
territory
as established by the Utilities Commission of the State of Iowa (herein "city consumers")
and all consumers
without the corporate limits for all lawful purposes, including public and private use, and upon such
terms,
conditions, restrictions and regulations as may be adopted pursuant to this ordinance. (Ord. 2002-0457)
