Chapter 12.24 CONDEMNATION BY GAS OR ELECTRIC COMPANIES
Section 12.24.010 Purpose.
Any individual or corporation authorized to construct and
operate gas or electric transmission
and distribution systems in the city, is authorized and empowered to appropriate and condemn
under the laws of the state so much private property as shall be necessary for the construction
and operation of gas or electric transmission and distribution systems with all the necessary pipe
lines, regulator stations, poles, wires, associated trenches, substations, plants and other requisites
of such systems provided that prior to the commencement of each and every condemnation
procedure specific authority must first be obtained from the city council by resolution.
Information bearing on the request for condemnation shall be furnished by the individual or
corporation to the city engineer no less than twenty calendar days prior to consideration of said
resolution by the city council. (Ord. S-20378, 1972).
