Any person, firm or corporation failing to secure a permit or failing to thereafter annually renew same shall cease to use or maintain any of the encroachments mentioned in this chapter, and it shall be then the duty of the director of public works to close said areas, vaults, rooms and openings in the public right-of-way and to remove the outside stairways or other encroachments and obstructions in, upon, over and above the public right-of-way, the cost for closing or removing same to be borne by and recoverable from the party who owns, operates, constructs, uses or maintains said encroachment.  (Ord. 82/T-800).
