Section 17.36.100 Skywalk district and skywalk system map.

    1. There is created a "skywalk district" which shall consist of the area enclosed by and including the right-of-way of the following streets:
    Commencing at the point of the intersection of the center lines of Second Street and Jennings Street, thence proceeding west along the center line of Second Street to the point of the intersection of the center lines of Second Street and Pearl Street, thence proceeding north along the center line of Pearl Street to the point of the intersection of the center lines of Pearl Street and the east-west alley between Seventh Street and Eighth Street, thence proceeding east along the center line of such east-west alley to the point of the intersection of the center lines of such east-west alley with the center line of Nebraska Street, thence proceeding south along the center line of Nebraska Street to the point of the intersection of the center lines of Nebraska Street and Sixth Street, thence proceeding east along the center line of Sixth Street to the point of the intersection of the center lines of Sixth Street and Jackson Street, thence proceeding north along the center line of Jackson Street to the point of the intersection of the center lines of Jackson Street and Seventh Street, thence proceeding east along the center line of Seventh Street projected to the point of intersection of the center lines of Seventh Street and Jennings Street, thence proceeding south along the center line of Jennings Street to the point of beginning.
    2. The exact location of existing portions of the skywalk system shall be shown and set forth on an official "Skywalk System Map" which shall be adopted by the city council and kept on file at the office of the board and at the office of the city clerk.  All additions or deletions to the skyway system, made in accordance with the provisions of this chapter, shall be recorded on the skyway system map, together with the appropriate ordinance or resolution number and date of change.  The skyway system map shall be deemed amended by each resolution or ordinance accepting an easement for a portion of the skyway system or accepting completed construction of a skyway bridge.  The skyway system map may be otherwise amended by resolution.
    3. The general location of each part of and appurtenance to the entire planned skywalk system shall be shown on the "Skywalk System Plan Map," which shall be adopted by resolution of the city council and kept on file at the office of the board and at the office of the city clerk.  The city council must find the skywalk system plan to be financially feasible within the time frame of the plan as part of the adoption of the skywalk system plan map.
    The location of a planned portion of the skywalk system shall be within a distance of one-quarter of a block on either side of its indicated location on the skywalk system plan map.  The skywalk system plan map shall not be amended to relocate any portion of the skyway system a distance of more than one-quarter of the length of the block from the location shown thereon, unless all private property interests who would have had the right of connection as a consequence of the prior location are provided:
            a. Reasonable notice of such relocation and a hearing before the board; and
        b. An alternative plan for providing such private property interests access to the relocated portion of the skyway system without additional cost to the city; and
        c. The private property interests who shall be directly connected to the relocated skyway system shall agree in writing to provide the city with:
            (1) Easements, at no cost to the city, for public pedestrian travel through and over all skywalk corridors across their private property, and
            (2) Easements, at no cost to the city or private property interests denied the right of direct connection by relocation, for public pedestrian travel through and over all skywalk corridors across the requesting party's private property as necessitated in the alternate plan adopted in accordance with subsection 3b. of this section.
    The skywalk system plan map shall be amended by resolution of the city council, and such amendments shall be recorded on the skyway system plan map together with the appropriate resolution number and date of change.  (Ord. 84/T-3053)
