All responsibility for the maintenance, removal and replacement of the trees, (except as provided in Iowa Code Section 364.12(c), shrubs, and flowers in the public right-of-way in an industrial or commercial zone shall be the property owners expense and shall be done in accordance with the rules and regulations established by the city engineer.  In the event the property owner fails to comply with the rules and regulations so established, the city may, after giving written notice to the property owner, perform the necessary maintenance, removal, or replacement of the trees, shrubs, and flowers and charge the expenses incurred to the property owner and assess the cost against the abutting property.  (Ord. 91/T-9427)
