This chapter shall not apply except where such adjoining lots or parcels of land are both occupied by either the owner or his tenant or agent, and no owner or agent shall be required to build or maintain any portion of a partition fence, unless he shall be in the occupancy or engaged in using the lot liable therefor for building, storage or other purposes.
