Chapter 25.02 TITLE, PURPOSE, APPLICABILITY, ENFORCEMENT ACTIONS
Section 25.02.100 Exemptions.
Those portions of this Title 25 governing principal permitted uses, conditional uses, temporary uses
and
accessory uses shall not apply to the governments of the United States of America, the State of Iowa
and
their agencies and political subdivisions, and the City in the performance of their governmental functions.
All other provisions of this Title 25, including, but not limited to, space limits, parking and loading,
bulk
and density, floodplain regulations, and industrial performance standards shall be applicable to such
governments, agencies and political subdivisions, except that the City Council may, following a public
hearing with notice provided as set forth in Subsections 25.22.020(2)(c) and, if appropriate,
25.85.040(1)(h), determine that facilities and services essential for public safety may be exempt from
any
such standards except floodplain regulations if the following findings are made:
1. Application of normal zoning standards will not allow the establishment of
the subject public safety
facility or service;
2. All reasonable alternatives have been reviewed to assure that the public
safety facility or service is
optimally located and developed;
3. Only the specific zoning standards that cannot be met without compromising
the integrity of public
safety will be relaxed; and
4. Only the smallest increment of relief from zoning standards that will result
in effective provision of
essential public safety facilities or services will be allowed. (Ord. 2004-0816; 88/T-7005)
