Section 25.03.020 Findings of fact and legislative intent.

    1. The city council makes the following findings of fact:
            a. The last update to the Comprehensive Plan occurred in 1994.
            b. The City is in the process of creating an amendment to the Comprehensive Plan (the "Plan") passed and approved in February, 1994, said amendment to be a subarea study of the portion of the City known as the Stockyards.
            c. That the present zoning ordinance permits development inconsistent with the "Plan".
            d. That the City lacks the necessary tools for the encouragement of appropriate land use development within the stockyards in Sioux City, Iowa.
         e. That it is in the public interest to strengthen and expand and intensify existing areas of commercial and industrial development and to prevent further blight and deterioration in furtherance of the established goals and objectives of past and present city councils and various representative and advisory bodies as expressed in council resolutions and in public hearings; to prevent underutilization of existing commercial and industrial areas and the considerable public investment in place to serve said areas with necessary basic support services such as utilities, adequate parking, safe and convenient public transportation, streets and highways; to preserve and protect extensive urban renewal efforts, involving massive public investment already underway, and the reliance upon these investments by the private sector.
            f. That pending the necessary studies, hearings, and other preliminaries incident to proper consideration and decisions upon any revisions and amendments of the zoning ordinance and "Plan" that may be necessary as shown by such a comprehensive review, appropriate and salutary measures must be taken for a reasonable interim period  to protect the public interest by preserving the integrity of the review and potential revisions of the zoning ordinance and "Plan".
    2. It is hereby declared to be the intent of the city council of the City of Sioux City, Iowa to protect the review and revision of the zoning ordinance and "Plan" and to preserve the objectives and insure the proper implementation of the review and revision of the zoning ordinance and "Plan" by hereby adopting reasonable protective interim legislation during the review and revision processes and proceedings and thereby protect the public interest and welfare and prevent premature actions which could prejudice the integrity and objectives of the comprehensive review and result in the establishment of land-use patterns and development inconsistent with and violative of the intent of the proposed review and revision of the zoning ordinance and "Plan".
    It is the purpose of this law to define areas of the City which are affected by the mandated review and potential revisions of the zoning ordinance and "Plan" and the proposed amendments which would result from recommendations and implementations affecting the same. The city council has included in this interim law only those significant areas which have been determined as vital to the preservation of the "Plan" and potential amendments thereto and consistent with previously proposed amendments and resolutions of the city council and in the best interests of the health, safety, morals, and general welfare of the City and to this end the council has provided for a review and appeals procedure to avoid or minimize any inequities and undue hardships.
    It is the intent of the city council that these controls shall terminate on June 30, 2000 if not sooner terminated by appropriate council action. (Ord. 2000-8666)
