Chapter 25.06 ADMINISTRATIVE BODIES
Section 25.06.310 Jurisdiction, authority and duties.
In addition to the jurisdiction, authority and duties conferred on him by other provisions of state
law and this Code, the manager, or his duly delegated representative shall have the following
jurisdiction, authority and duties:
1. Supervision of division. The inspection services division manager shall supervise,
manage
and be responsible for the affairs and activities of the department, its officers, subordinates and
employees, and may recommend to the city manager the employment of experts, technical
assistants, clerks, secretaries and such other personnel as shall be provided by ordinance and pay
for their services and other necessary and proper expenses, but only out of such appropriation as
may from time to time be made therefor.
2. Rules, Regulations and Application Forms. The manager shall, consistent with
the express
standards, purposes and intent of this title, promulgate, adopt and issue such procedure rules,
regulations and forms as are in his opinion necessary to the effective administration of that part
of this title affecting his division. All rules, regulations and forms issued by the manager shall be
filed with the city clerk and shall be public records of the city open to inspection by interested
parties at reasonable times upon reasonable notice; copies thereof shall be available for sale in
the inspection services division department of building inspection at a fee as established from
time to time by the city council to help defray the printing costs of such forms.
3. Records. The manager of inspection services shall maintain current files
of all certificates of
occupancy and all notices of violation issued by or entrusted to his office, for such time as
necessary to ensure continuous compliance with the provisions of this title;
4. Report. The manager of inspection services shall, at least annually, prepare
and submit a
report to the city manager, the community development director, setting forth the objectives of
the inspection services division for the coming year. The manager of the inspection services
division shall keep a separate record of all building permits issued for land of structures located
in a -FW floodway overlay zone or a -FF flood fringe overlay zone. At the end of each calendar
year, he shall submit a statistical report on building permits issued to the chief executive officer
of the city for inclusion in required reports to the Federal Insurance Administration.
5. Applications - Receipt, Processing. Referral to Interested Parties and Agencies.
The
manager of the inspection services division shall receive and cause to be expeditiously processed
the following applications:
a. Certificates of Occupancy. The inspection services
manager shall receive and process
applications for certificates of occupancy as provided in Chapter 25.10 of this title and Chapter 3
of the Sioux City building code.
b. The inspection services manager shall, before issuing
a building permit, require the
applicant to show evidence that all permits required from other levels and agencies of
government relative to the alteration of drainage or the alteration of the flow characteristics of a
stream have been issued.
6. Investigation of Applications. Whenever the planning and zoning commission
or board of
adjustment shall by general rule or specific direction so request, the inspection services division
manager shall conduct or cause to be conducted such surveys, investigations and field studies,
and shall prepare or cause to be prepared such reports, maps, photographs, charts and exhibits, as
shall be necessary and appropriate to the processing of any application filed with the inspection
services division manager.
7. Inspection. The manager of the inspection services division shall undertake
such regular and
continuing programs of inspection of work approved and under way and of existing structures
and uses as may be feasible and proper within the limits of staff and funds; shall undertake such
inspections as may be necessary to the performance of his duties.
Nothing in this subsection 7 shall be interpreted to prevent any person entitled
to relief in law
or equity by reason of a violation of the provisions of this title from bringing an appropriate
action to secure such relief.
8. Technical Aid. The manager of inspection services division shall offer such
technical aid,
assistance and expertise to the board of adjustment, the planning and zoning commission and
planning director as they may reasonably require in the performance of their duties. (Ord. S-36968,
