Section 25.12.1010 - Authority

Pursuant to authority established in Section 25.06.610 paragraph 6, the zoning administrator may hear and review applications for and authorize the following minor modifications from the requirements of the zoning ordinance in compliance with the standards contained within this subsection:
    1. Reduction of required off-street parking or loading by no more than 25 percent;
    2. Increase in permitted height of a fence by no more than two feet;
    3. Increase in permitted height of a building by no more than ten percent;
    4.     Reduction of required residential side yard setbacks for principal structures by no more than two feet;
    5. Reduction of required residential front and rear yard setbacks for principal structures by no more than five feet;
    6. Reduction of minimum lot area requirements by no more than 10 percent;
    7. Reduction of required residential front, side and rear yard setbacks without limit as required to provide handicapped access ramps to a dwelling.
    8. Increase in the permitted height of a detached residential garage to the greater of 20 feet or the height of the principal structure.
    9. Reduction of front, side or rear yard setbacks without limit as required to allow reconstruction of a historically accurate structure;
    10. Reduction of residential corner side yard setbacks by no more than five feet;
    11. Reduction of residential accessory structure rear and side yard setbacks by no more than one foot, if roof overhangs on the building wall closest to the property line for which relief is being sought are limited to one foot and if the building wall closest to the property line for which relief is being sought has a one-hour fire rating.
    12. Increase in the permitted aggregate area of detached accessory structures to the greater of 1000 square feet or the ground area of the principal structure.
    13. Permit attachment of detached accessory structures that encroach into required setbacks for attached structures.
    14. Allow lattice-work truss and guy-wired telecommunication towers in zones other than AG, MA, ML, and MH.
    15. Allow telecommunication towers, accessory to a principal permitted or approved conditional use, in excess of the maximum height permitted in the zoning district, up to a maximum of 75 feet.
    16. Increase in the permitted encroachment for roof overhangs into required front and corner side yard setbacks by not more than two feet.
    17. Driveways to parking areas on portions of lots where they would not otherwise be allowed under Section 25.96.020 (4) provided the hearing examiner determines that there is no way to provide off street parking in an otherwise lawful manner, provided the property had access to off street parking  in the past, and provided  the City Engineer approves the location of the curb cut leading to the parking area .
