Section 25.12.730 Conditions for use interpretations.

The following conditions shall govern the zoning administrator and the board of adjustment on appeals from the zoning administrator, in issuing use interpretations:
    1. No use interpretation shall permit a use listed as a permitted or conditional use in any zone to be established in any other zone in which such use is not so listed.
    2. No use interpretation shall permit any use in any zone unless evidence shall be presented which demonstrates that it will comply with each use limitation established for the particular zone.
    3. No use interpretation shall permit any use in a particular zone unless such use is substantially similar to other uses permitted in such zone and is more similar to such other uses than to permitted uses or conditional uses in a more restrictive zone.
    4. If the proposed use is most similar to a use permitted only as a conditional use in the zone in which it is proposed to be located, then any use interpretation permitting such use shall be conditioned on the issuance of a permit for a conditional use pursuant to Subchapter III of Chapter 25.06 of this title.
    5. The board shall not have jurisdiction over the interpretation of -FW flood overlay zone or -FH flood hazard overlay zone boundaries.  (Ord. S-36973, 1978; S-30424, 1976)
