Chapter 25.52 BNH HEAVY NEIGHBORHOOD BUSINESS ZONE
Section 25.52.030 Principal permitted uses.
Except as limited by Section 25.52.070 of this chapter, the following uses are permitted as of right
in the
BNH zone subject to the standards hereinafter set forth:
1. All uses permitted in the BN zone;
2. Gasoline service stations, subject to the following standards:
a. Space lighting shall be shielded so as to prevent
the direct glare of beams onto any adjacent
residentially zoned or used property.
b. No repairs other than minor automobile repairs shall
be performed on the premises and any such
minor repairs shall be performed only within the principal building on the premises.
c. No overnight storage of material, merchandise and
equipment shall be permitted except within the
principal building and except that refuse and trash may be stored in closed containers and in an area
screened from view at all points on any public or private property or street.
d. All vehicles on the premises, other than those at
the pumps or waiting for immediate service, shall
be stored in parking areas or lots which are screened from view from adjacent residential properties. No
partially dismantled or wrecked vehicle shall be stored for more than a total of eight hours outside
of a
completely enclosed building.
e. Screening shall be provided along all lot lines abutting
or adjacent to residentially zoned or
developed property, sufficient to block substantially any view of service station operations and stored
material and equipment from all points located on or not more than eight feet above the lowest elevation
of
such residential property; in the event such screening is not sufficient to block totally any view of
stored
waste or waste receptacles additional screening shall be provided sufficient to block totally any view
of
stored waste or waste receptacles. In no event shall this section be deemed to require more than
full
enclosure (including roof) of stored waste, including waste receptacles, and an opaque fence not more
than
seven feet in height extending the full length of not more than three sides of the subject property;
provided,
however, such screening may be reduced in height so as to avoid shading a solar energy collector located
on
said adjoining property.
f. Perimeter landscaped open space shall be provided
in the required front yard.
g. In the event any gasoline service station use is
discontinued or abandoned, the owner shall be
subject to the following specific regulations and time limits, to the other applicable requirements
of this
title, and to municipal codes relating to building and fire prevention.
(1) The property, including
all buildings, accessory structures and landscaping, shall be maintained
so as to prevent any adverse effect on surrounding properties.
(2) All signs and sign supports
shall be removed within thirty days following cessation of the
automobile service station use.
(3) The provisions of the Sioux
City fire code concerning abandonment of underground gasoline
tanks shall be complied with.
(4) Gasoline pumps and lighting
poles shall be removed at the time of compliance with the provision
of the Sioux City fire code as set forth in paragraph (3) above;
3. Drive-in establishments of any use permitted in the BN zone, subject to the
following additional
standards:
a. The site shall be large enough to provide off-street
accommodation for all automobiles of patrons.
The site shall be so located that traffic ingress and egress from the site will not interfere with existing
traffic
on the streets from which access to the site is intended.
b. Screening shall be provided along all lot lines abutting
or adjacent to residentially zoned or
developed property to block substantially any view of operations, stored material and equipment from
all
points located on or not more than eight feet above the lowest elevation of such residential property. In the
event such screening is not sufficient to block totally any view of stored waste or waste receptacles,
additional screening shall be provided sufficient to block totally any view of stored waste or waste
receptacles. In no event shall this section be deemed to require more than full enclosure (including
roof) of
stored waste including waste receptacles and an opaque fence not more than seven feet in height extending
the full length of not more than three sides of the subject property; provided, however, such screening
may
be reduced in height so as to avoid shading a solar energy collector located on said adjoining property.
c. No music or sound amplification system shall be installed
that may be heard on abutting or adjacent
residentially zoned or used property.
d. Space lighting shall be shielded so as to prevent
the direct glare of beams onto any adjacent
residentially zoned or used property;
4. Self-service drive-in auto wash facilities which may include dispensing of
gasoline or other motor
vehicle fuels of not more than four one-car bays subject to the standards set forth in subsections 25.52.030-2.a.,
b. and c. above;
5. Grocery stores, delicatessens and specialty food stores which may include
the accessory sale only of
gasoline or other motor vehicle fuels;
6. Restaurants which do not permit dancing or the consumption of beer or intoxicating
liquor on the
premises.
7. Bed and breakfast homes, subject to the following standards:
a. Minimum gross habitable floor area: 750 square feet
per rooming unit
b. Minimum total lot area: 5000 square feet
c. Screening: Parking lots for more than three vehicles
shall be screened from neighboring residentially
zoned or used properties. The screening shall be continuous, six feet in height, and shall consist
of a fence,
foliage or a combination of such materials.
8. Bed and breakfast inns, subject to the following standards:
a. Minimum gross habitable floor area: 500 square feet
per rooming unit
b. Minimum total lot area: 5000 square feet
c. Screening: Parking lots for more than three vehicles
shall be screened from neighboring residentially
zoned or used properties. The screening shall be continuous, six feet in height, and shall consist of
a fence,
foliage or a combination of such materials.

. Churches, synagogues, chapels and similar places of religious worship or instruction.
