Chapter 25.64 ML LIGHT MANUFACTURING ZONE
Section 25.64.070 Performance standards.
Each structure or use permitted in the ML zone shall meet the following performance standards:
1. Physical Appearance. With the exception of gasoline pumps, drive-in theaters
and
commercially operated outdoor recreation uses all operations shall be carried on within an
enclosed building, provided that new materials or equipment in operable condition may be stored
in the open, and normal daily wastes of an inorganic nature may be stored in containers not in a
building when such containers are not readily visible from a street. The provisions of this section
shall not be construed to prohibit the display of merchandise or vehicles for sale or rental, or the
storage of automotive vehicles, farm machinery, trailers, or similar equipment when in operable
conditions.
2. Fire Hazard. No operation shall be established which fails to meet the Uniform
Fire Code as
adopted by the city. This provision shall not be considered to prohibit the use of normal heating
fuels, motor fuels and welding gases when handled in accordance with other ordinances of the
city.
3. Noise. No operation shall be carried on which involves noise in excess of
the normal traffic
noise of the adjacent street at the time of daily peak hour of traffic volume. This standard shall be
measured at the property line. All noises shall be muffled so as not to be objectionable due to
intermittence, beat frequency, or shrillness.
4. Sewage and liquid wastes. All operations shall comply with the sewer use
rates and
regulations ordinance of the city, and any applicable regulations of state or federal agencies
responsible for pollution control. No wastes of a chemical, organic or radioactive nature shall be
injected or buried in the ground or stored in the open on the surface except in approved
containers.
5. Smoke, Particulate Matter and Gases. No use shall be established which fails
to meet the air
quality regulations of the Iowa Department of Environmental Quality pertaining to emissions of
smoke, particulate matter, fugitive dust, gases and other air contaminants.
6. Odor. The emission of odors that are generally agreed to be obnoxious to
any considerable
number of persons shall be prohibited. Observations shall be made at the property line of the
establishment causing the odor. As a guide to classification of odor, it shall be deemed that
strong odors of putrefaction, fermentation or soy bean milling processes tend to be objectionable
and that such odors as associated with baking or the roasting of nuts or coffee shall not normally
be considered obnoxious.
7. Vibration. All machines shall be so mounted as to minimize vibration and
in no case shall
such vibration be perceptible at the property line without the use of instruments. The use of
steam or broad hammers shall not be permitted in this zone.
8. Glare and Heat. All glare producing operations, such as welding arcs and
open furnaces,
shall be shielded so that they shall not be visible from the property line and nearby surfaces shall
be of a type which will minimize the reflection of such glare beyond the property line. No heat
from furnaces or equipment shall raise the temperature of materials or the air at the property line
