Section 25.71.060 Conditional use.

Free standing parking lots and parking lots accessory to permitted uses subject to the following:  
    A conditional use permit authorizing the establishment of a free standing parking lot may be approved by the board of adjustment subject to the administrative procedures for conditional uses set out in section 25.12.310 - 25.12.380.  However, no request for a conditional use permit in the HC-1 zone shall be transmitted to the board of adjustment for review without prior recommendation of the historic preservation commission.  The recommendation of the historic preservation commission together with the record of its proceedings shall be forwarded to the board of adjustment and shall be conclusive as to all issues of facts and law before the board of adjustment and any party contesting the recommendation of the historic preservation commission shall bear the burden of proof.  Further, any decision of the historic preservation commission can be appealed to the city council.
    In its review to determine whether or not to authorize the board of adjustment to review a conditional use permit application, the historic preservation commission shall limit its review to the historical compatibility of a proposed land use or structure to the remainder of the area around it.
