Section 25.71.120 Encroachments into the public right-of-way.

1. Projecting signs. Sections 25.02.030 - 25.02.080 of the zoning ordinance notwithstanding it shall be the policy of the City of Sioux City that within the HC-1 zone projecting signs attached to buildings and projecting wholly or partially into the public right-of-way but otherwise permissible under the requirements of section 25.71.110 shall be allowed subject to approval by the city manager or designee of an encroachment permit pursuant to chapter 17.28 of the municipal code. In reviewing requests the city manager or designee shall ensure compliance with design guidelines enumerated in section 25.71.080 above, shall ensure compliance with all other applicable requirements of the municipal code, and shall ensure that liability to the city is minimized.

2. Outdoor seating for the service of food and beverage shall be allowed subject to the issuance of a revocable outdoor sidewalk seating easement. (Ord. 2000-8767)
