Section 25.86.160 Nonconforming Uses.

    1. A structure or the use of a structure on land which was lawful before the passage or amendment of this chapter but which is not now in conformity with the provisions of this chapter may be continued subject to the following conditions:
        a. If such use is discontinued for twelve consecutive months, any future use of the building premises shall conform to this chapter.
        b. If any nonconforming use or structure is destroyed by any means, including floods, to an extent of 50 percent or more of its value prior to destruction, it shall not be reconstructed except in conformity with the provisions of this chapter.
        c. Uses or adjuncts thereof which are or become nuisances shall not be entitled to continue as nonconforming uses.
    2. Except as provided in Section 25.86.160-4 any use which has been permitted as a conditional use or variance shall be considered a conforming use. (Ord. 2001-0415; 89/T-7348)
