Chapter 26.20 PROSPECT HILL CONSERVATION AREA PLAN
Section 26.20.030 Other provisions.
1. Duration of Plan Controls. The duration of the regulations and controls shall
be maintained
and continued in effect for a period of twenty years from April 14, 1980, the date of the original
approval of this plan by the city council.
2. Applicability of Plan Controls. The regulations and controls of this plan
shall be directly
applicable to all property which is not to be acquired when the owner thereof acquires project
land. Properties which are not to be acquired must comply with the applicable rehabilitation
property requirements of this plan. Such requirements shall be imposed by one or more, but not
limited to, the following methods:
a. Enforcements and applications of the laws and regulations
of the city and state;
b. By separate written agreements;
c. By the exercise of the power of eminent domain.
3. Termination of Revitalization Activities. When, in the opinion of the city
council, the
desired level of revitalization has been attained or economic conditions are such that the
continuation of the exemption granted by the revitalization act would cease to be of benefit to the
city, the city council may repeal the ordinance establishing this revitalization area and approving
this plan. In that event, all existing exemptions shall continue until their expiration.
4. Procedure for Changes in Approved Plan. Adjustments or modifications resulting
from
experience during project execution are authorized in the administration of this project; provided,
that the intent of this approved plan is not changed. Any modification or adjustment is subject to
the same requirements and procedures by which this plan was originally approved.
5. Underground Utility Lines. All distribution and regulatory systems will be
placed
underground. This will include both new and existing facilities. (Ord. S-40159, 1980)
