Section 4.123.135 Prohibition--Late Night Sales.

    1. It shall be unlawful for any person to permit the consumption of alcoholic beverages, beer or wine between the hours of two o’ clock A.M. and six o’ clock A.M. on a weekday and Saturday, and between the hours of two o’clock A.M. and eight o’ clock on Sunday upon premises under the person’s possession where those premises are accessible to the public.
    2. It shall be unlawful for any person to permit the presence of open containers of alcoholic beverages, beer or wine between the hours of two o’ clock    A.M. and six o’ clock A.M. on a weekday and Saturday, and between the hours of two o’clock A.M. and eight o’ clock on Sunday upon premises under the person’s possession where those premises are accessible to the public.
    3. It shall be unlawful for any person to consume alcoholic beverages, beer or wine between the hours of two o’ clock A.M. and six o’ clock A.M. on a weekday and Saturday, and between the hours of two o’ clock A.M. and eight o’ clock A.M. on Sunday upon premises accessible to the public.
    4.  For the purposes of this section, the following terms shall have the meanings ascribed to them:
        a. “Premises under the person's possession" means that the person has control of the premises either through ownership of the premises, a lease, whether written or oral, of the premises, or granted the use of the premises by any other means by the person otherwise entitled to possession of the premises.
        b. "Premises accessible to the public" means a structure or designated area where the general public is given access to the premises at any time whether for free or for a charge.  Included within this definition are private clubs where memberships are given or sold to individuals for the privilege of belonging to the private club and accessing a structure for social and business purposes of the membership.
