Chapter 4.14 TEMPORARY OUTDOOR CIRCUSES, CARNIVALS, EXHIBITIONS AND SHOWS
Section 4.14.070 Exemptions.
This chapter shall not apply to the following events or activities:
1. Outdoor art fairs not exceeding forty-eight hours in duration;
2. Sidewalk sales, outdoor flea markets or similar activities not exceeding
twenty-four hours in duration,
sponsored by a group of retailers on an annual or semiannual basis;
3. Any outdoor circus, carnival, exhibition or show sponsored or maintained
solely by and for the sole
benefit of any religious, charitable, educational or fraternal organization not organized or maintained
for
profit, or by any state, county or agricultural fair or exhibition operated and maintained by a corporation
or
association not organized or maintained for profit. This exemption shall not apply where such
circus,
carnival, exhibition or show is operated or maintained by any person, firm, corporation or association
engaged in the business of furnishing such entertainment, even though under the auspices of one or more
of
the exempt class, as set forth in this section;
4. Any outdoor circus, carnival, exhibit or show which is continuously conducted
and operated at a fixed
permanent location and for which a certificate of zoning and certificate of occupancy have been obtained
from the department of inspections and housing services.
5. Any exhibition which is conducted and operated temporarily by a permanent
business on part of its
yard or lawn or lot adjacent to the structure housing the permanent business; provided, however, that
said
exhibition must comply with all other applicable ordinances.
