Chapter 4.36 SIGN REGULATIONS
Section 4.36.050 Signs not requiring permits.
The following signs are exempted from the sign permit requirements:
1. Sign Types Allowed and Provisions.
a. Construction sign. One per street frontage
not to exceed sixteen square feet for each sign in
residential zones or thirty-two square feet for each sign in all other zones. Such signs may be
erected five
days prior to the beginning of construction and shall be removed five days following the completion
of
construction. Any construction signs in excess of these requirements must follow the requirement
for sign
permits under 4.36.040.
b. Directional/Informational Signs. One per street
entrance, not to exceed six square feet in sign area
for each sign (such sign may be illuminated but shall not flash).
c. Holiday Decorations.
d. Home Occupant/Occupation Sign. One per dwelling unit
not to exceed one square foot in
cumulative sign area and must be attached flat against the dwelling.
e. Incidental Signs. Not to exceed one square foot in
cumulative sign area.
f. Real Estate Sign. One per street frontage, not to
exceed twelve square feet in cumulative sign area
per premises in residential zones or sixty-four square feet in cumulative sign area per premises in
all other
zones. Such a sign shall be removed within ten days following the closing of sale, rent or lease.
g. Political Signs.
(1) Political signs per street
frontage not to exceed sixteen square feet in cumulative sign area per
premises in a residential zone and not to exceed thirty-two square feet in cumulative sign area per
premises
in all other zones. Any political signs in excess of these requirements must follow the requirements
for sign
permits under 4.36.040.
(2) No political sign shall be placed
at any location where it may because of its size, location,
content, or coloring constitute a traffic hazard or a detriment to traffic safety by obstructing the
vision of
drivers, by detracting from the visibility of any traffic control device or by being confused with an
authorized traffic control device.
h. Public Signs.
i. Search Lights, Banners, Festoons and Other Promotional
Devices. Such devices are allowed only
under the following provisions:
(1) A business in a commercial
or industrial area. Such device may be used for a period of not more
than thirty consecutive days limited to one such period per calendar year.
(2) In a residential area. Such
devices except search lights may be used not more than ten
consecutive days, limited to one such period per calendar year. Search lights are not allowed
in residential
zones.
j. Temporary Signs. One per street frontage, not
to exceed five square feet in cumulative sign area per
premises. Such a sign may be erected not more than five days prior to the event and shall be removed
within five days following the event.
k. Temporary Window Signs. May be used for not more
than thirty consecutive days and may not
cover more than twenty-five percent of the window area and are permitted on ground floor windows only.
l. Subdivision Identification Sign. One per street entrance
not to exceed twenty-four square feet per
sign. Such signs to be set back at least ten feet from any property line.
m. Signs not Intended to be Viewed from Any Public Right-of-way.
2. General regulations (for signs not requiring a permit).
a. No sign shall be illuminated unless otherwise provided
herein.
b. No sign shall be located in, under or over any public
right-of-way unless the portion of public right-of-way has first been vacated and proper authorization
through:
(1) Acquisition of title; or
(2) Acquisition of an easement;
or
(3) An encroachment permit under
Chapter 17.28 of the Municipal Code has first been obtained.
Encroachment permits for signs are limited to wall signs, as defined in Section 4.36.020.
c. The height of signs not requiring permits, shall
not exceed six feet in height.
d. Sign area allowed for signs not requiring permits
shall not be applied for the total sign area allowed
by zone.
e. Signs not requiring permits are not subject to the
setback requirement unless specifically stated
herein.
f. No signs shall be placed at any location where
it may, because of its size, location, content, or
coloring constitute a traffic hazard or a detriment to traffic safety by obstructing the vision of drivers,
by
detracting from the visibility of any traffic control device or by being confused with an authorized
traffic
