Chapter 4.36 SIGN REGULATIONS
Section 4.36.150 Off-premises advertising signs located in BNH, BC, BG, MA, ML and MH zones.
1. Signs Allowed.
a. Off-premises advertising signs (4.36.020(01)).
2. Sign Types Allowed.
a. BNH and BC Zones. Freestanding and
painted wall signs, both subject to the issuance of
a conditional use permit by the board of adjustment.
b. BG, ML, MH and MA Zones. Freestanding
and painted wall signs.
3. Sign Area Allowed. The total sign area for an off-premises
advertising sign shall not
exceed: (See off-premises advertising sign table, Section 4.36.250)
a. BNH and BC Zones. Two hundred eighty-eight
square feet plus embellishments;
b. BG, ML, MH and MA Zones. Six
hundred seventy-two square feet plus embellishments.
4. Height Restrictions. The height of off-premises advertising
signs shall not exceed:
a. BNH Zone. Twenty-five feet;
b. BC Zone. Thirty-five feet;
c. BG Zone. Forty-five feet;
d. ML, MH and MA Zones. Fifty-five feet.
5. Setbacks.
a. Off-premises advertising signs shall
be subject to the building setback requirements of
section 4.36.250.
6. Additional Regulations.
a. Off-premises advertising signs shall
be located so that a minimum distance of two
hundred feet ex-ists in all directions from other off-premises advertising signs except for the
following:
(1) Along Interstate
29 between the south city limits and U.S. Highway 20, all off-premises ad-vertising signs shall be located
so that a minimum of one thousand feet exists in all
directions from other off-premises adver-tising signs.
b. Off-premises signs shall not be erected
within three hundred feet of the following rights-of-way.
(1) Interstate
29 between Hamilton Boulevard and the Big Sioux River;
c. Off-premises advertising signs shall
not be located within a radius of one hundred feet of
any resi-dential zone.
d. Off-premises advertising signs shall
not be located within one hundred fifty feet of any
part of the premises of a public park or square, public or parochial school, church building or
cemetery, public build-ings designated and erected for cultural purposes, public museums, public
libraries and/or buildings housing the municipal, administrative or judicial seats of county, state
or federal government, or historical marker or monument or any public or private property or any
public street, road or highway bearing any legend, in-scription or notice which purports to record
a historical event, incident or fact conforming to the require-ments of the Code of Iowa.
e. Off-premises advertising signs shall
not be located within one-fourth mile in all directions
from the War Eagle monument and the Floyd Monument Obelisk.
f. No off-premises advertising signs
shall be erected within any area from a point one
hundred fifty feet west of Pearl Street to a point one hundred fifty feet east of Nebraska Street
and from the north line of the Missouri River to the north right-of-way line of Second Street
unless a variance has been granted by the board of adjustment in each case.
g. Off-premises advertising signs shall
not be located in, upon or over any public right-of-way unless said portion of public right-of-way has
first been vacated and proper authorization
through:
(1) Acquisition
of title; or
(2) Acquisition
of an easement; or
(3) An encroachment
permit pursuant to Chapter 17.28 of the municipal code has been
obtained. Encroachment permits are limited to wall signs as defined in Section 4.36.020.
h. Off-premises advertising signs may
be illuminated but shall not flash.
i. Off-premises advertising signs shall
be constructed on steel monopole supports, unless a
variance has been granted by the board of adjustment for other than monopole signs.
j. Off-premises advertising signs are
prohibited from the following zones: AG, RE, RS120,
RS70, RD60, RG50, RG28, RG20, RG8, BN and BGM.
7. Sign free corridors.
a. No off-premise sign shall be permitted
within three hundred feet of the nearest right-of-way line of the following streets:
(1) Singing
Hills Boulevard between the primary ridge line of Loess Hills and South
Lakeport Street.
(2) Highway
75 between Glenn Avenue and Vine Avenue.
(3) U.S. Highway
20 between the Missouri River and Gordon Drive.
(4) South Lakeport
Street between Sunnybrook Drive and U.S. Highway 20.
(5) Hamilton
Boulevard between W. 19th Street and the north city limits.
(6) Outer Drive
between Hamilton Boulevard and Indian Hills Drive.
8. Sign free areas.
a. No off-premise signs shall be permitted
in the following areas:
(1) From the
primary ridge line of the Loess Hills to U.S. Highway 75 between Lincoln
Way and the south city limits.
(2) From the
primary ridge line of the Loess Hills to the Big Sioux River between
Interstate 29 and Janet Avenue.
(3) From the
primary ridge line of the Loess Hills to the Big Sioux River between
