1. Annual Franchise Payment. A franchisee of a franchise under this chapter shall pay to the city an annual fee in an amount equal to three percent of the annual gross revenues. Such payment shall be in addition to any other payment charges or fees owed to the city by the franchisee and shall not be construed as payment in lieu of personal or real property taxes levied by state, county or local authorities.

    2. Amendment of Percentages. The annual franchise payment percentage designated in this section may be amended no more than once every calendar year by the city. Any such amendment shall be consistent with the applicable rules of the FCC and other regulatory agencies.  (Ord. S-35454, 1978)
