Chapter 4.70 BROADBAND TELECOMMUNICATIONS NETWORKS
Section 4.70.185 Extension by franchisee beyond service area minimum.
The franchisee may extend its broadband telecommunications network beyond the service
area
minimum upon receipt by the franchisee, from subscribers to such extension, of pro rata costs in
excess of the cost of construction in a service area minimum. Upon completion of such
construction, the date of completion and cost of construction shall be certified by the franchisee
to the city manager. New subscribers in such areas may receive service thereafter, by paying their
pro rata share of the cost of construction. If any subscriber's service in such extended service
areas is disconnected for any reason, no extension charge shall be made if that dwelling unit is
reconnected. After the completion of three years from the date of construction, the requirement
of contribution to the extension shall not apply to new subscribers. (Ord. S-42358, 1981)
