Chapter 4.70 BROADBAND TELECOMMUNICATIONS NETWORKS
Section 4.70.500 Further agreement and waiver by franchisee.
1. The franchisee shall not be excused from complying with any of the terms
and conditions of this
chapter or the franchise ordinance by any failure of the city, upon any one or more occasions, to insist
upon
the franchisee's performance or to seek franchisee's compliance with any one or more of such terms or
conditions.
2. The franchisee shall have no recourse whatsoever against the city for any
loss, cost, expense or damage
arising out of any provision or requirement of this chapter or the franchise ordinance or the regulation
