Chapter 4.78 ODOR CONTROL
Section 4.78.110 Odor Appeals Board.
1. There is hereby established a board known as the Odor Appeals Board.
2. The membership of the Odor Appeals Board for consideration of an appeal filed
under this chapter
shall be appointed by the Environmental Advisory Board and shall be comprised of two members of the
Environmental Advisory Board who are not members of the Citizen Odor Committee, two members of the
Citizen Odor Committee representing citizens of the community, and one member representing industry
as
established under Section 4.78.040. The Chair of the Citizen Odor Committee, if not a member of
the
Appeals Board for a given appeal, shall designate one of the five members to chair the meeting of the
Odor
Appeals Board. Members of the Appeals Board shall serve for a period of twelve (12) months.
3. The Board shall:
a. Hold hearings upon appeals filed with the Enforcement
Official under Section 4.78.120-2.
b. Arbitrate disputes that may arise regarding notice
given under Section 4.78.050-1. that an industry,
facility, or source is a significant odor generator; and
c. Provide for recording and transcription of the hearing
through the Enforcement Official. (Ord.
