Section 4.78.130 Procedure for Processing Appeals.

1. After receiving notice of an appeal filed under Section 4.78.120 of this code, the Enforcement Official shall notify the Chair of the Odor Appeals Board for purposes of hearing the appeal as provided in Section 4.78.110-2.

2. The Enforcement Official shall set a time, place and date of hearing which shall not be later than ten days after receiving notice of the filing of the appeal, unless otherwise agreed to by the Appellant and the Enforcement Official.

3. The Enforcement Official shall notify the Appellant and members of the Odor Appeals Board of the time, place and date of hearing not less than three days before said date. (Ord. 92/U-425)
