Chapter 5.20 SOLID WASTE
Section 5.20.030 Keeping of solid waste materials and yard waste on premises.
1. For Removal by City. It shall be the duty of
every owner of any premises from which solid waste
materials or yard waste is to be removed by the city in accordance with Section 5.20.080 to place all
garbage and/or rubbish, and/or recyclable refuse and/or yard waste separately or combined in acceptable
containers as specified in Section 5.20.035.
2. For Removal of Garbage by Owner or Private Refuse
Collector. It shall be the duty of every owner
of premises from which garbage is to be removed either by the owner or by a private refuse collector
acting
in accordance with Section 5.20.080 and/or Section 5.20.100 to deposit all garbage which accumulates
on
the premises in metal, plastic, or disposable containers which shall be watertight, equipped with tight-fitting
insect-proof and rodent-proof covers, or if disposable containers are used, they must be securely closed
and
of sufficient capacity to store accumulated garbage for removal at intervals specified in Section 5.20.140.
3. For Removal of Rubbish and Recyclable Materials by
Owner or Private Refuse Collector. It shall be
the duty of every owner of premises from which rubbish or recyclable material is to be removed in
accordance with Section 5.20.080 and/or Section 5.20.100 to deposit all rubbish or recyclable material
in
such containers as will prevent the rubbish or recyclable materials from being scattered or blown upon
any
other premises or public ways in the city.
4. For Removal of Yard Waste by Owner or Private Refuse
Collector. It shall be the duty of every
owner of premises from which yard waste is to be removed in accordance with Section 5.20.080 and/or
5.20.100 to deposit all yard waste in such containers as will prevent the yard waste from being scattered
or
blown upon any other premises or public ways in the city.
5. It shall be the duty of the owner to pick up solid
waste materials or yard waste that has been
scattered, blown about, or spilled from his/her containers onto the owner's premises, onto any other
premises, or onto public or private ways in the city. When retrieving solid waste materials or
yard waste
materials that has been blown about, scattered, or spilled onto the property of another, the retrieving
party
shall take the most direct and accessible route to and from the materials to be retrieved, quit the
property as
quickly as is possible, and not unduly interfere with the lawful use of the property. (Ord. 94/U-2559,
