Chapter 8.32 INTERFERING WITH OFFICER
Section 8.32.010 Eluding a peace officer.
It is unlawful for any person to elude, attempt to elude, or fail to stop for a peace officer, by use
of a motor
vehicle or any other means, after the officer has given visible and/or audible order or signal for the
person
to stop or desist from further movement. "Visible and/or audible order" includes:
1. A spoken command to stop or halt;
2. The officer's use of police patrol car siren or flashing red light(s);
3. The officer's use of a police whistle; and
4. The officer's waving of an arm or arms.
However, this section shall not apply if a person eludes or attempts to elude a marked official law
enforcement vehicle driven by a uniformed peace officer as defined in this section and in so doing is
the
driver of a motor vehicle who willfully fails to bring the motor vehicle to a stop after being given
a visual
(flashing red light) and audible (siren) signal to stop. (Ord. 99-8131; S-34775, 1978)
