Chapter 8.48 MISCELLANEOUS OFFENSES
Section 8.48.070 Criminal street gangs.
1. Definitions. As used in this ordinance, unless the context otherwise requires:
a. "Criminal acts" shall mean any of the following or
any combination of the following:
(1) Any act involving firearms
or weapons prohibited by Chapter 8.04 of the 1992
Municipal Code.
(2) Any act in violation of
Chapter 8.10 of the 1992 Municipal Code relating to loitering
for solicitation.
(3) Any act prohibited by Section
8.08.050 of the 1992 Municipal Code relating to
unlawful assembly.
(4) Any act prohibited by Section
8.08.060 of the 1992 Municipal Code relating to
rioting.
(5) Any act prohibited by Section
8.08.070 of the 1992 Municipal Code relating to failing
to disperse.
(6) Any assault as defined in
Section 8.08.095 of the 1992 Municipal Code.
(7) Any act in violation of
Chapter 8.24 of the 1992 Municipal Code relating to offenses
against property.
(8) Any act in violation of
Chapter 8.32 of the 1992 Municipal Code relating to inferring
with an officer.
b. "Criminal street gangs" shall mean any ongoing organization,
association, or group of
three or more persons, whether formal or informal, having as one of its primary activities the
commission of one or more criminal acts, which has an identifiable name or identifying sign or
symbol, and whose members individually or collectively engage in or have engaged in a pattern
of criminal gang activity.
c. "Pattern of criminal gang activity" shall mean the
commission, attempt to commit,
conspiring to commit, or solicitation of two or more criminal acts, provided the criminal acts
were committed on separate dates by two or more persons who are members of, or belong to, the
same criminal street gang.
d. "Gang recruitment" shall mean the enticement, assisting,
intimidation, or causing any
person to join, become a member of, or participate in the activities of any criminal street gang.
2. Criminal acts committed by criminal street gang members. A member of a criminal
street
gang who willfully aids and abets any criminal act, or gang recruitment, committed for the
benefit of, at the direction of, or in association with any criminal street gang, commits a simple
