Chapter 8.68 NOISE CONTROL
Section 8.68.070 Issuance of permit and appeal.
1. Applications for issuance of a sound permit will be review by the Chief of
Police or designee and a
decision made as to approval within seven (7) days. A permit shall be issued to a person who submits
an
application meeting the application requirements under this chapter and who has paid the application
fee,
except as set forth below.
2. No permit shall be issued to any applicant or for any activity for which the applicant
or the associated
activity has been convicted of a violation of this chapter within the previous year.
3. Any person denied a permit may appeal the denial to the City Council by filing
a written notice of
appeal with the City Clerk within seven (7) days of the denial. The notice of appeal shall contain
the
following information:
a. The name, address and contact information of the
individual or entity filing the appeal; and
b. A written statement of the decision being appealed
which describes in detail the specific basis for
the appeal.
4. Hearing on the appeal will then be scheduled before the City Council at a
regular council meeting.
