Chapter 8.72 NUISANCES
Section 8.72.080 Nuisance defined.
Whatever is injurious to the senses, or an obstruction to the free use of property, so as essentially
to interfere with the comfortable enjoyment of life or property, is a nuisance.
Examples of nuisances are:
1. All diseased animals running at large;
2. All ponds or pools of stagnant water;
3. Carcasses of animals not disposed of within twenty-four hours after death
as provided by
law;
4. Accumulations of refuse or the maintenance of a private dump in violation
of city
ordinances;
5. The pollution of any public well or cistern, stream, lake, canal or body
of water by sewage,
chemicals, creamery or industrial wastes or other substances;
6. All weeds, vines, brush or other growth which constitute a health, safety
or fire hazard;
7. Dense smoke, noxious fumes, gas and soot, or cinders, in unreasonable quantities;
8. The use of a common public drinking cup or roller towel;
9. The distribution of samples of medicines or drugs, unless such samples are
placed in the
hands of an adult person;
10. All gambling devices, slot machines and punchboards;
11. All houses kept for the purpose of prostitution or promiscuous sexual intercourse,
gambling houses, houses of ill fame and bawdy houses;
12. All places where intoxicating liquors are kept for sale, barter or distribution
in violation of
law, and all liquors, bottles, kegs, pumps, bars and other property kept at and used for
maintaining such a place;
13. Any vehicle used for the transportation of intoxicating liquor, or for promiscuous
sexual
intercourse or any other immoral purpose;
14. The public use of profane or obscene language;
15. All snow and ice not removed from public sidewalks twelve hours after the
snow and ice
has ceased being deposited thereon;
16. All trees, hedges, billboards, or other obstructions which prevent persons
from having a
clear view of traffic approaching an intersection from cross streets in sufficient time to bring a
motor vehicle driven at a reasonable speed to a full stop before the intersection is reached;
17. All trees infected with Dutch elm disease;
18. Cotton-bearing cottonwood trees and all other cotton-bearing trees;
19. All trees and shrubbery permitted to grow into the public right-of-way in
such a manner
that they impede or are hazardous to vehicular or pedestrian traffic;
20. All wires which are strung less than ten feet above the surface of the ground;
21. All buildings, walls and other structures which are structurally unsafe,
constitute a fire
hazard or are otherwise dangerous to human life, constituting a hazard to self-safety, health or
public welfare by reason of inadequate maintenance, dilapidation, obsolescence, fire hazard or
abandonment; however, repair to, modification of, or demolition of unsafe or dangerous
buildings or structures shall be made pursuant to the procedures set out in Chapter 20.06.
22. All explosives, inflammable liquids and other dangerous substances stored
in any manner
or in any amount other than that provided by ordinance;
23. All use or display of fireworks except as provided by ordinance;
24. All unnecessary noises and annoying vibrations;
25. Obstructions and excavations affecting the ordinary use by the public of
streets, alleys,
sidewalks or public grounds except under such conditions as are permitted by the council;
26. Any use of property abutting on a public street or sidewalk or any use of
a public street or
sidewalk which causes large crowds of people to gather, obstructing traffic and free use of the
streets or sidewalks, except as provided by ordinance or permitted by the city council;
27. The obstructing or encumbering by fences, buildings or otherwise of the
public streets,
alleys, sidewalks and commons;
28. All junkyard operations except as provided by ordinance. (Ord. 89/T-7711;
