Chapter 8.80 SPECIFIED CRIME PROPERTY
Section 8.80.010 Definitions.
Unless otherwise expressly stated or unless the context clearly indicates a
different intention,
the following terms shall, for the purpose of this chapter, have the following meanings:
1. "Bootlegging" means the illegal sale or
service of alcoholic liquor, wine, or beer in
violation of Chapter 4.123 of this code or Chapter 123 of the Code of Iowa.
2. "Chief of Police" means the person who has
the responsibility to supervise and direct the
police department and for purposes of this chapter may include his or her designee.
3. "Controlled substance" means a drug, substance
or immediate precursor as defined by
Chapter 124 of the Code of Iowa.
4. "Gambling" means games of skill or chance
as defined by Chapter 99B and prohibited by
Chapter 725 of the Code of Iowa.
5. "Owner" means any person, agent, firm, corporation,
association, or a partnership,
including a mortgagee in possession in whom is vested all or part of the legal title to property or
all or part of the beneficial ownership and the right to
present use and enjoyment of the premises, or an occupant of that structure.
6. "Person" means any natural person, association,
partnership, corporation, or other legal
entity capable of owning or using property.
7. "Prostitution", "Pimping" and
"Pandering" means those acts or activities as defined by
Chapter 725 of the Code of Iowa.
8. "Specified crime property" means any structure
or that part of a structure in which activity
involving the unauthorized delivery or manufacture of a controlled substance, illegal gambling,
bootlegging, prostitution, pimping, or pandering is occurring, or any structure in which seven (7)
violations of Chapter 8.08 of this code have occurred within a twelve (12) month period.
9. "Structure" means any building or structure
or any part thereof, including but not limited
to, offices or apartments. (Ord. 96/U-4728)
