BOARD OF ADJUSTMENT
The Board of Adjustment is a quasi-judicial board composed of seven volunteer citizens who review decisions of the Zoning office. The Board occasionally grants variances from the provisions of the Zoning Ordinance to relieve some unnecessary hardship that is imposed on a property owner due to the provisions of the Zoning Ordinance.
The Board also hears requests for Conditional Use Permits, which are uses that may be allowed in a given zone, but may have a special impact or uniqueness that requires a careful review of the use at the specific location requested.
Temporary Use Permits are uses of land that are temporary in nature and usually located in undeveloped areas of the City. They are uses, which, if discontinued, will allow for the rapid conversion of the land to an allowable use in the zoning district.
If you find yourself in a situation that requires review by the Board of Adjustment, you may file an appeal to them through the Zoning Administration office. The Board meets regularly on the 2nd and 4th Tuesday of each month. The application for the requested action must be filed in the Zoning office by the application deadline that is three weeks before the meeting date. There is a nominal fee of $250 that must accompany the completed application. Additionally, a detailed site plan may need to accompany the application.
The City is responsible for notifying property owners within 200 feet of any boundary proposed for change of a pending action. The Zoning office then prepares an agenda, makes the necessary notifications, and compiles responses to report to the Board at the public hearing. If the Board acts favorably to the request, the applicant is then approved to proceed with the application process to pursue the proposed project. If the request is denied, an appeal to the District Court within 30 days of the Board's decision may be filed. If construction or action based on the Board's decision prior to the end of the appeal periods, it is at your own risk.

All meetings are held at 4:30 p.m. or at the conclusion of the Planning and Zoning Commission meeting that begins at 4 p.m., whichever comes earlier. The meetings are held in the City Council Chambers located on 5th Floor of City Hall.
